1. Scope & Provider

These General Terms and Conditions (GTC) apply to all orders placed through the online shop at www.firstbeautylab.com, operated by:

By placing an order, you accept these terms. These terms apply to consumers within the meaning of the Austrian Consumer Protection Act (Konsumentenschutzgesetz, KSchG).

2. Contract Formation

The product presentations in our online shop do not constitute binding offers but rather invitations to place an order.

By clicking "Checkout" and completing payment, you submit a binding order. You will receive an order confirmation by email. The contract is formed when we confirm the order or dispatch the goods.

We reserve the right to refuse orders in the event of pricing errors, stock shortages, or suspected abuse.

3. Prices & Payment

All prices displayed on our website include the statutory value-added tax (VAT/MwSt.) applicable in Austria. No additional taxes or fees are added at checkout.

We accept the following payment methods: Visa, Mastercard, American Express, Klarna, PayPal, EPS, Sofort, Apple Pay, and Google Pay. All payments are processed securely via Shopify Payments.

Payment is due at the time of order. We do not store your payment details.

4. Delivery

We deliver to all EU member states. We do not currently ship to Switzerland or countries outside the European Union.

Shipping costs: Austria €3.90, Germany and all other EU countries €9.90. Free shipping from 2 Serums.

Orders are processed within 1-2 business days. Delivery times: Austria 2-3 business days, Germany 4-6 business days, other EU countries 4-6 business days.

In-person pickup at our institute (Börsegasse 12/EG 1, 1010 Vienna) is available free of charge, next business day after order confirmation.

Risk of loss passes to you upon delivery. If you are a consumer, risk passes when the goods are handed over to you (not to the carrier).

5. Right of Withdrawal

If you are a consumer in the European Union, you have the right to withdraw from the contract within 14 days of receiving the goods, without giving any reason.

To exercise your right of withdrawal, you must inform us by means of a clear statement (e.g. by email to hello@firstbeautylab.com) of your decision to withdraw from this contract.

If you withdraw, we will reimburse all payments received from you, including delivery costs (except supplementary costs resulting from your choice of a delivery method other than the least expensive standard delivery we offer). The reimbursement will be made no later than 14 days from the day on which we receive the returned goods.

You must return the goods without undue delay and no later than 14 days from the day you communicate your withdrawal. You bear the direct cost of returning the goods.

You are liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.

6. 30-Day Satisfaction Guarantee

In addition to your statutory right of withdrawal, we offer a 30-day satisfaction guarantee. If you are not satisfied with your serum within 30 days of receiving it, we will refund the full purchase price.

The guarantee applies to opened products with no minimum content requirement. It applies to first-time customers purchasing individual serums (not Sets or Duos). To initiate a return, email hello@firstbeautylab.com with your order number.

Refunds are processed within 14 days of receiving the returned product, to the original payment method.

7. Warranty & Defects

The statutory warranty provisions under Austrian law apply. For consumers, the warranty period is 2 years from the date of delivery (§ 922 ABGB, as amended by the VGG 2022).

If you receive a defective product, please contact us at hello@firstbeautylab.com with your order number and a description or photo of the defect. We will arrange a repair, replacement, or refund in accordance with the applicable law.

8. Liability

We are liable for damages caused by intent or gross negligence without limitation. For slight negligence, our liability is limited to foreseeable, contract-typical damages, except in cases of personal injury where liability is unlimited.

Product liability under the Austrian Product Liability Act (Produkthaftungsgesetz, PHG) remains unaffected.

9. Data Protection

We process your personal data in accordance with our Privacy Policy, available at www.firstbeautylab.com/privacy-policy. By placing an order, you acknowledge having read our Privacy Policy.

10. Applicable Law & Jurisdiction

These terms are governed by Austrian law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

If you are a consumer residing in the EU, you also benefit from the mandatory provisions of the consumer protection law of your country of residence.

For consumers, the courts at your place of residence or at our registered office in Vienna are competent. For business customers, the exclusive place of jurisdiction is Vienna, Austria.

11. Online Dispute Resolution

The European Commission provides an online dispute resolution platform at https://ec.europa.eu/consumers/odr. We are neither willing nor obligated to participate in dispute resolution proceedings before a consumer arbitration board.

12. Severability

Should any provision of these terms be or become invalid, the remaining provisions shall remain in full force and effect. The invalid provision shall be replaced by a valid provision that comes closest to the economic purpose of the invalid provision.
